Does anyone here know about drinking & driving on a motorized 3 wheeler bicycle? ?

what would happen if someone with a felony because of having 2 DUI's was pulled over for riding a motorized 3 wheel bicycle? Would it be considered another felon? I wonder how much jail time they would get?
